NEW CUSTOMER CAMPAIGN
TERMS & CONDITIONS
1. By participating in this Campaign, you will be deemed to accept these Terms and Conditions.
2. Campaign Period: This Campaign commences on 01 April 2023 and concludes on 31 December 2023.
3. Entry to Campaign
i. Eligible Participant: Entry into this Campaign is open to new customers (without an existing FedEx Express account) who: (i) sign up for a FedEx Express account at any time during the Campaign Period, and (ii) make Eligible Shipments (specified below).
ii. Cash accounts are not eligible to participate in this Campaign.
iii. If a participant is a FedEx corporate account holder, then an individual person may be nominated as its representative (“Nominated Representative”) and enter on the participant’s behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per participant.
iv. Persons under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
v. Incomprehensible, objectionable and incomplete entries will be invalid and will not be eligible for the rewards.
vi. FedEx accepts no responsibility for any late, lost or misdirected entries including delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
4. Rewards and Campaign Mechanics
i. An Eligible Participant may be rewarded as follows:
For Corporate Account
a. By making a single Eligible Shipment within seven (7) days of receiving new FedEx account number, an Eligible Participant will be entitled to receive a FedEx premium item.
b. By making three (3) or more Eligible Shipments (including the first shipment above) within thirty (30) days after receipt of new FedEx account number, the Eligible Participant will receive an additional set of Central shopping vouchers worth THB 1000.
c. By making three (3) or more Eligible Shipments each month during the 31st to 120th day (i.e., the second month to the fourth month) after receipt of new FedEx account number, the Eligible Participant will receive a set of Central shopping vouchers worth THB 2000.
For Personal Account
a. By making a single Eligible Shipment within seven (7) days and achieving three (3) or more Eligible Shipments within thirty (30) days of receiving new FedEx account number, an Eligible Participant will be entitled to receive a FedEx premium item and Central shopping vouchers worth THB 500.
b. By making three (3) or more Eligible Shipments each month during the 31st to 120th day (i.e., the second month to the fourth month) after receipt of new FedEx account number, the Eligible Participant will receive a set of Central shopping vouchers worth THB 1000.
ii. “Eligible Shipments” mean all shipments tendered to FedEx and paid in Thailand for all international trade lanes.
iii. The rewards given out hereunder will be issued to Eligible Participants via express mail within two (2) months from the end of the Campaign Period.
iv. As part of the Campaign, each Eligible Participant shall only be entitled to receive a maximum of:
a. THB 3000 worth of Central shopping vouchers per Corporate Account;
b. THB 1500 worth of Central shopping vouchers per Personal Account.
v. FedEx reserves the right to replace the reward stated herein with other items of equivalent value without notice. The reward stated herein cannot be exchanged for cash, cash-equivalents or any other gifts, goods or service of value.
Eligible Participants qualify and may also choose to join the My FedEx Rewards program. An Eligible Participant will receive an invitation email to sign-up for the loyalty program. An Eligible Participant will only begin earning points from Eligible Shipments after successfully signing up for the My FedEx Rewards program. My FedEx Rewards Terms and Conditions apply.
vi. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Campaign.
5. Data Privacy:
i. By participating in the Campaign, you hereby consent to Federal Express, its parent and affiliates (collectively “FedEx” for the purposes of this clause), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the personal data you have provided (including across jurisdictions) for purposes of conducting and administering the Campaign; and for relationship management, sales, marketing, advertising, and promotion purposes, which purposes include any other purpose as authorized by you, or as otherwise required or permitted by law.
ii. You also agree that: (a) the consent herein overrides any earlier withdrawal of your consent; (b) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (c) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry. 6. General
i. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Campaign, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.
ii. Eligibility excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, printers, suppliers, providers and agencies associated with the promotion stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.
iii. FedEx reserves the right to require the Eligible Participants to execute a certificate of eligibility prior to awarding the Eligible Participants with the prize, confirming that he/she is not excluded from entry into this Campaign pursuant to these Terms and Conditions and that the Eligible Participants has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the rewards.
iv. By entering this Campaign, unless otherwise advised by the participant, each participant consents to the information they submit being entered into a database which may be used by FedEx in any media for future promotional and publicity purposes.
v. If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the promotion, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.
vi. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will control.
vii. In the event of any discrepancies with respect to this Campaign, FedEx's decision is final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.
viii. FedEx reserves the right to amend these Terms and Conditions at any time without notice.
