TERMS & CONDITIONS: WIN BIG. SAVE BIG(“PROGRAM”)

AGREEMENT

1. You (hereinafter referred to as "You", "Your", "Customer", or "Participant") agree that the terms and conditions provided in this agreement (“Agreement”) govern your participation in the Program.

2. By tendering shipments, you or in the case of a business account, a nominated representative on behalf of his/her company, will be deemed to have accepted these Terms and Conditions.

3. This Program is undertaken only for the reason of promotion of goodwill and is in no way an attempt to improperly influence the Participant to act in a way that would benefit FedEx, where they otherwise would not have taken such action.

4. By participating in the Program, the Participant understands that FedEx is not asking the Participant to make any decisions that are unethical or illegal or in violation of

Participant’s own policies.

5. By participating in this Program, Participant confirms that they are not a government-owned or controlled company.

Program Period (“Program Period”)

6. The Program commences on November 15, 2024, and concludes on January 10, 2025 (“Program Period”).

7. Discounts/ Rewards will not be extended to beyond the Promotion Period.

ENTRY TO PROGRAM

1. Entry into this Promotion is open to participants who open a business account online on fedex.com/za

2. A cash account holder is not eligible for this Promotion.

3. To qualify for this Promotion, Participants must ship and reach the assigned target during the Promotion Period.

4. For the avoidance of doubt, the following accounts are not eligible to participate in this Promotion:

a. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx , its related entities, suppliers, subcontractors, FedEx Worldwide Service Account service providers and agencies associated with the Program stated herein as well as employees, agents, officers, and representatives of any government department, government owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.

b. Accounts in cash status/ overdue for payment to FedEx / outstanding payment due to FedEx / dispute, all as determined by FedEx in its sole discretion.

c. Customers / account holders who are going through negotiations for contract renewal, participation in new projects, biddings/tenders/request for proposals (RFPs), or any other negotiations that remain pending conclusion during the Promotion Period; and

d. A government owned or controlled company account and/or accounts owned by government officers.

5. This Promotion is open to persons of majority age.

6. All decisions regarding eligibility to participate in the Promotion are solely within the discretion of FedEx.

PROGRAM MECHANICS

7. By making Eligible Shipments (defined below) to or from South Africa, Participants stand a chance to win.

8. Eligible Shipments must meet all the following requirements:

a. International Priority (IP), International Priority Freight (IPF), FedEx International Economy (IE), FedEx International Economy Freight (IEF), FedEx International Priority® Direct Distribution, FedEx International First®, FedEx® Envelope, FedEx® Pak, FedEx 10kg or FedEx 25kg Box service shipments, spot-rate, Last minute rates (LMR), CS hotline or International Economy Direct Distribution (IED) service shipments.

b. Shipments tendered to FedEx during the Program Period (i.e. shipments tendered by the Participant before the end of the Program Period as notified by FedEx).

c. Shipments billed to a Participant (as indicated in the Program invitation email from FedEx) and paid in full during the Program period.

9. Only shipments billed to a FedEx account owned by the Participant in South Africa will be eligible for the reward program.

10. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Program.

11. The number of Eligible Shipments is determined based on the number of air waybills. One FedEx air waybill equals one shipment

REWARDS: SELECTION AND NOTICE OF REWARDS TO RECIPIENT(S)

12. Rewards shall be awarded to, and redound to the benefit of, the registered owner corresponding to a FedEx Account Number qualified to participate under this program as per this set of Terms and Conditions.

13. Any rewards should only be used for the benefit of the company participating in the program and not the individual employees of that company for personal use. In the event taxes and other levies on the discount/ rewards are imposed by applicable government or tax authorities, Participants shall be fully responsible for such payment.

14. The top 5 customers with the highest number of shipments and a minimum revenue of USD 600 during the promotion period will be eligible for the reward.

15. In event of a tie, customers with the highest revenue will qualify for the reward

Hospitality Suite tickets to Joburg Super Kings match

16. The top 5 winners each will receive two (2) Suite tickets to a Joburg Super Kings (JSK) match at Wanderers Stadium during the upcoming competition in January-February 2025.

17. Winner and their Plus ones need to be at least 18 years old

18. The dates for the match tickets offered will be solely determined by FedEx.

19. The winners will receive an email confirming their reward and the same will be communicated to them by their respective FedEx Sales executive.

20. The email confirming the winners will be emailed to the Participant at the same email address to which the Invitation Email was sent.

21. Please note, this ticket invite is extended only to you and is exclusive and non-transferable. The entitlements that are included as part of the ticket are mentioned in the ticket terms and conditions

22. FedEx reserves the right to replace the prize stated herein with other items of equivalent value without notice.

23. FedEx will not be liable in the event should one of the following occur:

a. Selected winner’s email inbox is full.

b. Selected winner’s email inbox has been deactivated.

c. The e-mail address provided by a participant is non-existent, incorrect, or incomplete.

d. Incorrect and/or inaccurate information including personal information provided by “selected winner” including without limitation name, telephone numbers, e-mail addresses, addresses., etc.

e. Delay or failure of any postal operator or of the internet, computer, or any internet service provider.

24. All Participants are solely responsible for managing their e-mail inbox, including but not limited to checking their e-mail and complying with the instructions for redeeming their prize(s).

GENERAL

25. FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a participant or other parties in connection with this Program, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.

26. FedEx shall not be responsible for any expenses and cost including out of-pocket expenses related to or as a consequence of participation in this Program.

27. No liability can be attributed to FedEx in the event of improper use by the Participant of the prizes or use by people who are unsuitable due to age or physical/mental conditions.

28. FedEx shall not be liable for any malfunction, defect or issue faced with any product(s) or service(s) issued hereunder as prizes for this Promotion. All guarantees and limitations issued by the supplier in relation to such product(s) and service(s) shall apply.

29. FedEx reserves the right to require a Participant to execute a certificate of eligibility prior to awarding them with the Program reward, confirming that the Participant is not excluded from entry into this Program pursuant to these Terms and Conditions and that the Participant has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the Program rewards.

30. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Program, these Terms and Conditions will prevail.

31. By participating in the Promotion, Participants hereby consent to FedEx and their authorized agents, service providers and business/Country/ Marketing partners to collect, use, disclose, transfer and share the personal data Participants have provided (including across jurisdictions) for:

a. purposes of conducting and administering the Promotion.

b. relationship management, sales, marketing, advertising, and Promotion purposes which purposes include any other purpose as authorized by Participants, or as otherwise required or permitted by law.

32. Participants also agree that: (i) the consent herein overrides any earlier withdrawal of Participants' consent and will remain effective unless such the consent herein is withdrawn; (ii) the consent herein does not supersede or replace any other consents which Participants may have provided to FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/Country/ Marketing partners may contact Participants via any mode and media about products and services offered by FedEx regardless of Participants' registration(s) with any do not contact/call registry.

35. In addition, Participants hereby represent and warrant that Participants are the user and/or subscriber of the contact details provided by Participants as part of the Promotion.

36. If this Program is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Program, FedEx reserves the right in its sole discretion to cancel, terminate, modify or suspend this Program.

37. The terms and conditions of carriage in the applicable FedEx Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Air Waybill and these Terms and Conditions, the former will control.

38. In the event of any disagreement between a Participant and FedEx with respect to interpretation of these Terms and Conditions, the decision made by FedEx will be final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.

39. FedEx reserves the right to amend these Terms and Conditions at any time without notice.

40. In the event of any disagreement between a Participant and FedEx with respect to interpretation of these Terms and Conditions, the decision made by FedEx will be final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.
