1. Applicability. Program “Participants” are existing FedEx customers, invited via email to ‘ship more, save more’ with FedEx. By continuing to ship with FedEx, Participants are deemed to accept these Program Terms and Conditions.

2. Duration. The Program starts from the date on which the Participant receives the invitation email and continues at FedEx’s discretion and until further notice.

3. Three Month Promotional Discount.

a. For a period of three months from the start of the Program (“Initial Period”), all Participants will receive a 50% discount (“Promotional Discount”) on the FedEx Express List Rates for Promotion Eligible Shipments (defined below), irrespective of their shipment volumes. The Promotional Discount applies to transportation charges of Promotion Eligible Shipments, and does not apply to other charges, including but not limited to fuel surcharge, duties and taxes and other surcharges.

b. “Promotion Eligible Shipments” means imports or exports (excluding Bill Third Party shipments) using FedEx International Priority (IP), FedEx International Economy (IE), FedEx International Priority Freight (IPF), or FedEx International Economy Freight (IEF) services. One air waybill equals one shipment, and a single shipment with multiple pieces constitutes one shipment.

c. For the avoidance of doubt, the Promotional Discount does not apply to the following FedEx services: FedEx 10kg and 25kg Box, spot rate, FedEx International Priority Direct Distribution (IPD), FedEx International Economy Direct Distribution (IED) or FedEx International First (INF).

d. The Promotional Discount will not apply to Participants who have outstanding unpaid invoices.

4. Volume Discount Tiers.

a. At the end of the Initial Period, Participants become eligible for a “Volume Discount”, dependent on the Participant’s Average Monthly Spend (defined below). The Volume Discount will vary depending on the Participant’s Average Monthly Spend, as per the percentage discount amounts stated in the Program invitation email sent to the Participant.

b. The Volume Discount will apply to Participant’s spend on transportation charges of Volume Discount Eligible Shipments (defined below), and does not apply to other charges, including but not limited to fuel surcharge, duties and taxes and other surcharges.

c. The Volume Discount will not apply to Participants who have outstanding unpaid invoices.

d. FedEx calculates “Average Monthly Spend” as follows:

i. For the first month after the Initial Period, the Average Monthly Spend is calculated based on the Participant’s gross spend on transportation charges during the Initial Period; and

ii. thereafter, the Average Monthly Spend is calculated based on the Participant’s cumulative gross spend on transportation charges from the start of the Program, up to and including the preceding 12 months, on a rolling basis.

e. “Volume Discount Eligible Shipments” means import and export shipments sent by Participant using International Priority (up to 15kg) and International Economy (up to 15kg) services. These services are eligible for the Earned Discount tiers attained.

f. The Volume Discount applies to FedEx Express List Rates in effect on the shipment date for Volume Discount Eligible Shipments. Participants can view the Volume Discount applied to their shipment(s) by referring to their FedEx invoice or referring to the FedEx Rate Sheet tool when logged in to their FedEx shipping account.

5. General

a. The Promotional Discount and the Volume Discount apply only to eligible shipments sent from a Participant’s single FedEx shipping account. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to receive the Promotional Discount or the Volume Discount.

b. The Promotional Discount and the Volume Discount cannot be used in conjunction with any other shipping discount(s) or offer(s) provided by FedEx.

c. The terms and conditions of carriage of FedEx Express in effect on the day of shipment, as referred to in the applicable FedEx Express Air Waybill and published on fedex.com, shall apply to the shipment. If there is a conflict between the terms and conditions of carriage and these Terms and Conditions, the former will control.

d. In the event of any discrepancies with respect to this Program, the decision of FedEx at its sole discretion, to the fullest extent permitted by law, is final. FedEx will not be obliged to provide the participants any benefits stated herein if contrary to any applicable laws or regulations.

e. FedEx reserves the right to alter, modify, suspend and/or terminate the discount(s) offered via this Program, modify the FedEx Express list rates published on fedex.com, and impose surcharges (including but not limited to fuel surcharge) at any time for any reason without notice, to the fullest extent permitted by law.

f. FedEx reserves the right to amend these Terms and Conditions at any time without notice, to the fullest extent permitted by law.
