FedEx First Flight - Campaign Terms and Conditions
1. The “FedEx First Flight” (“Campaign”) is a campaign organized by FedEx Philippines (“FedEx”) and which shall be governed by the terms and conditions set out herein and/or by such terms as FedEx shall impose from time to time. By tendering shipments using the FedEx account stated in the Campaign promotional email, you will be deemed to accept these Terms and Conditions.
2. Campaign Period (“Campaign Period”)
This Campaign commences on 1 August 2023 at 12:01 am Philippines time and concludes on 31 May 2024 at 11:59 pm Philippines time.
3. Entry to Campaign
Entry into this Campaign is open to new FedEx Express corporate account holders whose accounts are created by FedEx Dedicated Customer Service Representatives (DCRs) during the Campaign Period (“Participants”) and who receive a Campaign promotional email from FedEx. A holder of a cashed or deleted account is not eligible for this Campaign.
4. To participate in this Campaign, Participants must ship “Eligible Shipment(s)” with FedEx (as defined below).
i. An “Eligible Shipment” is a shipment which meets all of the following requirements:
a. Inbound or Outbound shipments tendered to FedEx Express during the durations stated in the campaign promotional email
b. Shipments billed to a Participant’s FedEx Express account (as indicated in the Campaign promotional email);
c. Not applicable to spot-rate shipments
5. For the FedEx Express corporate account, an individual person may be nominated as its representative (“Nominated Representative”) and enter on the Participant’s behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per Participant.
6. Persons under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
7. FedEx Express accepts no responsibility for any late, lost, or misdirected entries including delays in the delivery of the entry due to technical disruptions, network congestion, or for any other reason.
8. If the Participant does not want their personal information to be utilized by FedEx Express for further promotional or direct marketing activities, the Participant may call FedEx Express Customer Service at the following numbers: PLDT, Sun, Smart Subscribers: 1.800.10.46.33339; For Globe Subscribers: 1.800.8.46.33339; Other Network Subscribers: +63.45.4993900.
Rewards: Selection and Notice of Rewards Recipient
1. A Participant who ships Eligible Shipments to meet the tiered shipping goals stated in the campaign promotional email, will be rewarded with a voucher worth the amount stated in the campaign promotional email corresponding to the tier goal achieved.
2. The rewards will be sent via email to Participants who met the shipping goals within five (5) months after creating their FedEx account.
3. One air waybill equals one shipment. An air waybill with multiple packages will be considered one shipment.
4. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Campaign.
5. FedEx Express reserves the right to replace the reward stated herein with other items of equivalent value without notice.
6. If you are a Participant enrolled in any other FedEx promotional campaign or pricing program during the Campaign Period, you shall only be eligible to receive the applicable incentive or benefit from one out of all the campaigns and/or program in which you are enrolled. FedEx reserves the right to select which campaign or program under which you shall receive such applicable incentive or benefit.
General Terms and Conditions
7. FedEx Express shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a Participant or other parties in connection with this Campaign, including but not limited to personal injury and tax obligations that may arise from accepting any of the rewards, except for any liability which cannot be excluded by law.
8. Eligibility to participate excludes the directors, management, and employees (and their immediate families) of FedEx Express, its related entities, printers, suppliers, providers, and agencies associated with the Campaign stated herein as well as employees, agents, officers, and representatives of any government department, government-owned entity, juristic person funded by any government department, political party or public international organization, or any candidates for political office.
9. FedEx Express reserves the right to require the Participant(s) to execute a certificate of eligibility prior to awarding the Participant(s) with the prize, confirming that the winner is not excluded from entry into this Campaign pursuant to these Terms and Conditions and that the Participant(s) has complied fully with these Terms and Conditions. If requested by FedEx, truthful completion of this certificate is a precondition to the award of the rewards.
10. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing, or promotional material relating to this Campaign, these Terms and Conditions will prevail.
11. By participating in this Campaign, you hereby consent to Federal Express, its parent and affiliates (collectively “FedEx” for the purposes of this Clause 24), and their authorized agents, service providers and business/marketing partners to collect, use, disclose, transfer and share the personal data you have provided (including across jurisdictions) for purposes of conducting and administering the Campaign; and relationship management, sales, marketing, advertising, and promotion purposes, which purposes include any other purpose as authorized by you, or as otherwise required or permitted by law. You also agree that: (i) the consent herein overrides any earlier withdrawal of your consent; (ii) the consent herein does not supersede or replace any other consents which you may have provided to FedEx, their authorized agents, service providers and/or business/marketing partners; and (iii) FedEx, their authorized agents, service providers and/or business/marketing partners may contact you via any mode and media about products and services offered by FedEx regardless of your registration(s) with any do not contact/call registry. In addition, you hereby represent and warrant that you are the user and/or subscriber of the contact details provided by you.
12. If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, and any other causes beyond the control of FedEx Express, which corrupt or affect the administration security, fairness, integrity, or proper conduct of the promotion, FedEx Express reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.
13. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will control.
14. In the event of any discrepancies with respect to this Campaign, FedEx's decision is final and no other further correspondence will be accepted. FedEx will not be obliged to award the rewards if it is contrary to any applicable laws or regulations.
15. FedEx Express reserves the right to amend these Terms and Conditions at any time without notice.
