I am requesting that the company I am specifying in the application be accepted as a participant in the FedEx Government Contractor Program (GCP). I am authorized to make this request on behalf of the company.  I declare that we are not Freight resellers or Freight Forwarders.

I understand that both FedEx and the company I am specifying agree that the terms of this agreement, including the pricing provided by FedEx, are confidential and shall be held in strict confidence by both parties and may not be disclosed unless required by law. The applicant company agrees not to post or publicly display the terms or pricing. FedEx and the applicant company also agrees that any discussions or negotiations regarding the pricing offered or any changes thereto (including but not limited to future pricing offerings) are also confidential and are pursuant to this provision of confidentiality.

We fully understand and agree that if we are accepted by FedEx to participate in this program, only those shipments made on behalf of the Federal/State government to/from your location and the government site are eligible for GCP pricing. If the origin or destination is not a government site, then the appropriate government contract number must be listed in the shipper reference field on the FedEx air waybill. We will retain and use our commercial FedEx account number for all the shipments that are not in direct support of our government contracts. We agree that we will only engage in the GCP during the term of our government contract, and we agree to immediately terminate our use of this program at the termination/conclusion date of our government contract. We will update FedEx Government Services and advise of any changes which have taken place. If changes take place within the year, we agree to immediately contact FedEx Government Services to provide the updated information. We further agree that any violation of the terms and conditions contained herein and/or in the FedEx Service Guide or FedEx Freight FXF 100 Series Rules Tariff shall be grounds for immediate termination by FedEx from the GCP.

We further agree 1) that any violation of the terms and conditions contained herein and/or in the FedEx Freight FXF 100 Series Rules Tariff shall be grounds for immediate termination by FedEx from the GCP and 2) Shipments with a Bill of Lading that reflects freight charges of $2,500 or more are not eligible for the GCP pricing.
