No Purchase Necessary to Enter or to Win.

Eligibility: To be considered an eligible small business for purposes of the #BackingSmall Business Contest (“Contest”), the business and/or owner must meet all of the following criteria:

  1. The owner of the business must be a legal resident of Canada at the time of entry;
  2. The owner of the business must have reached the age of majority in their province/territory of residence as of the date of entry;
  3. The individual registering for the Contest on behalf of the business must be an authorized agent of the business;
  4. The business must be domiciled in Canada at the time of entry;
  5. If business is a subsidiary of another larger business, the subsidiary and its parent company must be a Canadian owned and based entity;
  6. Business must be for-profit and in continuous operation selling a product or service for not less than six (6) months as of 1 March 2024. Non-profit organizations and businesses whose primary use of profits is donation-based are excluded.
  7. The business must be currently active, lawful, have all necessary and required licenses and registrations as required by the jurisdiction(s) in which it operates;
  8. The business must be in good standing as of the time of entry and must remain so through the end of the Contest;
  9. The business must have a valid FedEx shipping account number in good standing as of time of entry;
  10. The business must have no more than 99 employees on its payroll at the time of entry (owners and part-time employees are included in employee count);
  11. Neither the business itself nor any owner of nor any investor in the business may be:
    • a previous FedEx small business grant contest winner;
    • a previous FedEx #BackingSmall contest winner
    • in any way affiliated with a franchised, direct seller business/pyramid marketing business model; or a car service (Uber, Lyft, etc). 
    • a FedEx OnSite location, FedEx Authorized ShipCentre location or any other reseller of FedEx services;
  12. The primary purpose of the business must not be competitive with FedEx or any of the FedEx operating companies;
  13. The business must not be under bankruptcy protection or have judicial liens or attachment

Employees of Federal Express Canada Corporation (“Sponsor”), Campus Intercept (“Administrator”), and each of their respective parent and affiliate companies (collectively with Sponsor and Administrator, the “Promotion Parties”) as well as the immediate family (spouse, parents, siblings, and children) and persons with whom such employee is domiciled are not eligible to participate in the Contest. Subject to all applicable laws and regulations. Void outside Canada and where prohibited. Eligible small businesses who participate in the Contest will be referred to as "Participant" in these Official Rules. Participation constitutes Participant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest, including the eligibility of small business applicants. Upon request by Sponsor, an applicant must provide proof of their identity and qualification under the above eligibility criteria. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Contest Timing: Contest begins at 10:00 a.m. Eastern Time (“ET”) on 1 March 2024 and ends at 11:59 p.m. ET on 30 April 2024 (“Contest Period”).

How to Enter the Contest: There are two (2) ways to earn entry:

1) Register and Ship: During the Contest Period, eligible Participants can register at  https://www.fedex.com/en-ca/small-business/backing-small/register.html by completing all required fields of the onscreen registration form, including providing Participant’s business FedEx account number. Participants must complete one (1) qualifying FedEx shipment originating in Canada during the Contest Period using FedEx Express, FedEx Ground, or FedEx Freight services and billed to the FedEx account number that was registered for the Contest. Limit one Participant per FedEx account number. By registering a FedEx account number you affirm and acknowledge that you are an owner or authorized representative of the FedEx account number, and are authorized to enter using such account number.

2) Mail-in Entry: Participants may earn entry to the contest, without completing a shipment, by hand-printing their full name, business name, full address, and FedEx account number on a 3" x 5" piece of paper and on a separate piece of paper, submitting a typed minimum 500-word essay about their business and mailing it in a separate hand-addressed, stamped envelope with sufficient postage to be mailed to: FedEx #BackingSmall Business Contest - 251 Consumers Road, Unit 1229, Toronto, Ontario, Canada, M2J 4R3. All mail-in entries must be complete to be eligible. All mail-in entries must be postmarked by 30 April 2024 and received no later than 14 May 2024 to be eligible. Mechanically reproduced or automated mail-in entries are not eligible.

Limit one (1) entry per Participant, regardless of method of entry or combination of methods of entry. An email address may only be used once. You may not enter the same email address with different FedEx accounts. In the event of a dispute as to any entry, the authorized account holder (as determined by Sponsor) of the FedEx account number used to register for the Contest will be deemed to be the Participant. The “authorized account holder” is the business assigned to the FedEx account number by FedEx. A potential winner may be required to show proof of being the authorized FedEx account holder or proof of being an authorized representative of the business associated with the FedEx account number. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. All entries become the property of the Sponsor and will not be returned.

Prizes and Approximate Retail Values (“ARV”): Grand Prize (1): CAD $25,000, awarded in the form of a cheque. Second Prizes (10): CAD $10,000, awarded in the form of a cheque. Third Prizes (5): CAD $5,000, awarded in the form of a cheque. The total ARV of all prizes is CAD $150,000.

Drawing: The winners will be selected in a random drawing on or about 31 May 2024, from among all eligible entries received/postmarked during the Contest Period. Limit of one (1) prize per Participant. Drawing will be conducted by the Administrator. Odds of winning a prize depend upon the total number of eligible entries received/postmarked from Participants during the Contest Period. Prizes will be awarded and winners will be notified by the Administrator.

Disqualification: Sponsor reserves the right, in its sole discretion, to disqualify any Participant at any  time that it finds to be tampering with the entry process, or the Contest; to be acting in violation of these Official Rules; or to be acting in an inappropriate or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Entries submitted into the Contest (“Submitted Entries”) must be consistent with Sponsor’s mission, strategy, and values and Sponsor reserves the right, in its sole discretion, to reject and/or disqualify any entries at any time that Sponsor deems to be hateful, slanderous, libelous, violent, obscene, defamatory, discriminatory (based on age, race, gender, religion, natural origin, physical disability, sexual orientation or political affiliation), profane, offensive, lewd, sexually explicit, pornographic, false, misleading, deceptive, self-mutilating (e.g. relating to murder, the sales of weapons, cruelty, abuse, etc.), illegal (computer hacking, underage drinking, etc.), threatening, harassing, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that contain images, words or symbols widely considered offensive to individuals of a certain race, gender, ethnicity, religion, sexual orientation or socioeconomic group, or that Sponsor believes may violate any applicable law or regulation or the rights of any third party or may subject the Contest, Sponsor, or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. For purposes of this paragraph, Submitted Entries include content on the Participant’s website and social media sites. Should Sponsor determine, in its sole discretion, that any announced winner has violated any of the prohibitions contained in these Official Rules or should be disqualified for any other reason, Sponsor shall have no obligation to award a prize to such Participant. As a condition of entry, Sponsor reserves the right to conduct a background check on any potential finalist and/or winner and reserves the right in its sole discretion to disqualify any Participant based on such background check if in its sole discretion, the Sponsor determines that awarding the prize to such Participant might reflect negatively on the Sponsor’s image and/or reputation.

General Rules: Sponsor reserves the right to substitute a prize of equal or greater value if any advertised prize is unavailable for any reason. No substitution or transfer of prize by Participant/winner is permitted, other than as described above. Winners will not receive difference between actual and approximate retail value. Taxes related to the prizes (if applicable) are the responsibility of the winning businesses. Each potential Prize winner may be required to execute and return, via email, a declaration of eligibility and liability/publicity release (where legal) (“Declaration package”) within five (5) days of attempted notification, or the prize may be forfeited and an alternate winner will be selected, time permitting. All winners will also be required to correctly answer unaided a time-limited arithmetic skill testing question in order to be eligible to win a prize within five (5) days of attempted notification, or the prize may be forfeited and an alternate winner will be selected. Participants bear the sole responsibility to ensure that their business policy does not prohibit the awarding of a prize prior to prize acceptance. Winners must have a FedEx account in good standing, at time of prize award as determined by Sponsor in its sole discretion. The authorized representative who entered on behalf of a business must also be in good standing with their employer at time of prize award or prize will be forfeited. The Promotion Parties are not responsible for lost, late, illegible, mutilated, misdirected or postage-due mailed entries; technical, hardware or software malfunctions; telephone failures of any kind; lost or unavailable network connections; or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic or other communications, whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, that may limit the ability to participate, or whether caused by any human error that may occur in the processing of the entries in the Contest. Sponsor reserves the right, at its sole discretion to modify or cancel the Contest if it is technically corrupted in any way, at its sole discretion, and award the applicable prizes from among all eligible entries received/postmarked prior to cancellation. Acceptance of a prize constitutes permission to use each winner’s name and photographs/videos/testimonials for promotional purposes without further compensation or permission except where prohibited by law, without further compensation or permission from winner. The Promotion Parties will have no liability or responsibility for any claim arising in connection with participation in this Contest or use of any prize that is awarded and assume no responsibility for any injury or damage to Participants or to any other person’s computer relating to or resulting from entering this Contest. By receipt of prize, each winner agrees to release, indemnify, and hold harmless the Promotion Parties from and against any claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize (“Claims”). By participating in this Contest, each Participant agrees to be bound by these Official Rules and the decisions of the Sponsor/Administrator.

Disputes: Participant agrees that: (a) Participant releases and will defend, indemnify and hold harmless the Promotion Parties from and all any and all Claims; (b) Claims arising out of or connected with this Contest, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a court located in the Province of Ontario; (c) Participant submits to sole and exclusive personal jurisdiction to said courts in the Province of Ontario for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all Claims, judgments, and awards shall be limited to actual damages of no more than CAD $100, including costs associated with entering this Contest, but in no event attorneys' fees; and (e) under no circumstances will Participant be permitted to obtain awards for and Participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participants or the Promotion Parties in connection with this Contest shall be governed by, and construed in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules of provisions (whether of the Province of Ontario, the federal laws of Canada, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.

Data Protection/Privacy Policy: Information collected by Sponsor in connection with this Contest may be used by Sponsor and shared with third parties involved in administration of the Contest in accordance with the online Privacy Policy posted on https://www.fedex.com/en-ca/privacy-code.html and applicable data protection laws. The Participant agrees to the collection, processing, and storage of his or her personal data by Sponsor for purposes of the Contest. By selecting the option to receive promotional emails from Sponsor, Participant agrees to receive future emails from any FedEx operating company. The data controller and the data recipient is Federal Express Canada Corporation. Any Canadian Participants understand their data will be transferred to the U.S.

Winners: To receive a Winners List by email, send an email to: fedexcontest@interceptgroup.com with The FedEx #BackingSmall Business Contest as the subject line. Requests must be received by 15 June 2024. Winners List will be sent after prizes have been awarded.
