FedEx Voyage from Vietnam Lucky Draw Campaign (“Campaign”)

CAMPAIGN SPECIFIC TERMS AND CONDITIONS

1. By submitting the enrolment form for this Campaign, you will be deemed to accept these Terms and Conditions.

Campaign Period

2. This Campaign commences on 15 January 2024 at 12:00 am AEDT and concludes on 31 March 2024 at 11:59 pm AEDT.

Eligible Participants

3. This Promotion is open to Eligible Participants who:

• hold a FedEx Express account; and
• receive an email from FedEx inviting them to participate in the Campaign; or
• fill up the designated online lucky draw enrolment form via Sales invitation or Facebook Ad post; and
• are (if a company) Australian registered companies; or
• are (if a natural person) Australian residents over the age of eighteen (18) years old.

4. Holders of cash accounts or deleted accounts are not eligible to participate in this Campaign.

5. If a Participant is a FedEx business account holder whose business or company is registered in Australia, then an individual person may be nominated as its representative ("Nominated Representative") and participate on the Participant's behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per Participant.

6. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, suppliers, subcontractors, service providers and agencies associated with the Campaign stated herein as well as employees, agents, officers, and representatives of any government department, government-owned entity, juristic person funded by any government department, political party or public international organisation, or any candidates for political office.

Shipment Eligibility

7. Eligible shipments must meet all the following requirements: 

• Must be booked, tendered to, and collected by FedEx in Vietnam.
• Delivered to Asia, Europe, Middle East, India Subcontinent, and African countries and territories stated below. 

• iii. Booked and sent during the date of Campaign enrolment until 31 March 2024.
• iv. Using any of the following FedEx Express International Services: FedEx International First®, FedEx International Priority® Express, FedEx International Priority®, FedEx® International Connect Plus, FedEx International Priority® Freight, FedEx International Economy®, FedEx International Economy® Freight.
• v. Total minimum consignment weight per shipment is one (1) kilogram.
• vi. Eligible Shipments must meet the requirements of FedEx’s applicable terms and conditions, including but not limited to the Standard Terms and Conditions of Carriage and Other Services.
• vii. Participants must use the FedEx Account Number specified on the campaign enrolment form when booking.
• viii. Shipments billed to the Participant’s enrolled FedEx Express account and paid in full during the Campaign Period. Third-party paid shipments are included.
• ix. All invoices relating to Eligible Shipments must be paid for by the Eligible Participant in accordance with the terms of the invoice or the Eligible Participant’s agreement with FedEx.

Entry to Campaign

8. Entry into this Campaign is open to FedEx account holders with eligible shipments during the campaign period. Shipment eligibility details are set out in Clause 7.

9. To enter this Campaign, participants must successfully enrol via the invitation email or submit an entry through the designated online lucky draw enrolment form during the Campaign Period.

10. Once enrolled, for every Eligible Shipment booked and shipped, an Eligible Participant will receive one (1) entry into the Lucky Draw for the chance to win one (1) of the prizes listed in Clause 16.

11. Multiple entries throughout the Campaign Period will correspondingly count as more chances to win the lucky draw.

12. Pooling of shipments from multiple FedEx accounts is not permitted and such pooled shipments are not eligible to earn entries to the Lucky Draw Campaign.

13. Incomprehensible, objectionable, and incomplete entries will be invalid and will not be eligible to earn entries to the Lucky Draw Campaign. 

14. FedEx accepts no responsibility for any late, lost or misdirected lucky draw entries including delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

Prizes and Selection of Winners

15. The draw will take place at 2 pm (AEST) on Monday 18 June 2024 (“Draw Date”) at 201 Coward Street, Mascot, NSW 2020, and will be conducted by FedEx.

16. The first three (3) unique Eligible Entries randomly drawn, which have been submitted by unique Eligible Participants in accordance with these Terms and Conditions (“Winner” or “Winners” as the context requires), will win one of the following Prizes, awarded in the following order:
    Major Prize: one (1) winner x Apple iPhone 15 128gb;
    Minor Prizes: two (2) winners x AU$300 shopping gift cards;

17. A list of Winners will be made available on fedex.com/au. Further, Winners will be notified in writing by email and/or by phone call.

18. Any taxes which may be payable as a consequence of a winner receiving a Prize are the sole responsibility of the Winners.

19. Each Winner is solely responsible for complying with any terms and conditions that may be imposed on the use of the Prize by a third party responsible for providing any Prize. Winners are deemed to have reviewed, understood, and accepted any such terms and conditions upon entry into this Campaign.

20. The Prizes will be sent from FedEx Express Australia Head Office – 201 Coward Street, Mascot, NSW 2020 within 30 days of the Draw Date. If any of the Winners cannot be contacted and/or are unable to accept the prize within four (4) weeks after the Draw Date, the Prize will be deemed forfeited. In such case, a new draw will take place.

21. To the extent permitted by applicable law, FedEx’s decision is final, and no correspondence will be entered into regarding results. The Prizes are not exchangeable, transferable or redeemable for cash or other products or services. FedEx will only award the Prizes following Winners’ validation and verification.

22. FedEx reserves the right to redraw in the event of an Eligible Participant being unable to satisfy these Promotion Terms and Conditions, forfeiting or not claiming a Prize. If any of the Prizes remain unclaimed or forfeited through ineligibility or otherwise, FedEx will conduct a further draw on Monday 22 July 2024 (“Redraw Date”) and the winner/s will be notified in writing and/or by a phone call. No further draws will be undertaken after the Redraw Date.

23. To the extent permitted by applicable law, FedEx reserves the right to replace the Prizes stated herein with other items of equivalent value without notice.

General Terms and Conditions

24. Except for any liability which cannot be excluded by applicable law, FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss) which is suffered by a Participant or other parties in connection with this Campaign, including but not limited to (a) personal injury; (b) tax obligations that may arise from accepting and using the Prize(s); (c) any technical difficulties or equipment malfunction (whether or not under FedEx’s control); (d) any theft, unauthorised access or third party interference; (c) incorrect details lodged by Participants; (e) any shipment or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by FedEx) due to any reason beyond the reasonable control of FedEx; (f) possession or use of a Prize; or (g) any failure by a Winner to adhere to any terms and conditions imposed by a third party responsible for providing the Prize. In addition, participation in this Promotion and/or use of the Prizes are entirely at the own risk of the Participant and for their own account.

25. FedEx reserves the right to require the winner(s) to execute a certificate of eligibility prior to awarding the winner(s) with the prize, confirming that the winner is not excluded from participating into this Campaign pursuant to these Terms and Conditions and that the winner(s) has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the Prizes.

26. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Promotion, these Terms and Conditions will prevail.

27. By entering this Campaign, each Participant consents FedEx Express Australia Pty Ltd to use his or her personal information in connection with this Campaign for the purposes of facilitating the conduct of the Campaign and providing the Prizes, including but not limited to, publishing the names of winners in emails and on fedex.com/au. Without limiting the foregoing, each Participant’s personal information provided in connection with this Promotion will be handled in accordance FedEx Privacy Policy, a copy of which is available by contacting FedEx or online (https://www.fedex.com/en-au/privacy-policy.html).

28. If this Campaign is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Campaign, FedEx, to the extent permitted by applicable law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Campaign.

29. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the FedEx Express Air Waybill and these Terms and Conditions, the former will prevail.

30. FedEx will not be obliged to award the Prizes if it is contrary to any applicable laws or regulations.

31. To the extent permitted by applicable law, FedEx reserves the right to amend these Terms and Conditions at any time without notice.
