1. By participating in this Promotion, you will be deemed to have accepted these Terms and Conditions between you and FedEx Express Australia Pty Ltd (ABN 41 000 495 269) trading as FedEx Express and TNT Express (“FedEx” or “TNT Express” as the context requires).

Promotion Period

2. The Promotion commences at 12 am (AEST) on Wednesday 29 May 2024 and closes at 11.59 pm (AEST) on Monday 30 September 2024.

Eligible Participants

3. This Promotion is open to Participants who:

a) hold an active FedEx Express account or an active TNT Express account; and

b) receive an email from FedEx inviting them to participate in the Promotion; and

c) is (if a company) an Australian registered company; or

d) is (if a natural person) an Australian resident over the age of eighteen (18) years old.

("Eligible Participants")

4. Holders of cash accounts or deleted accounts are not eligible to participate in this Promotion.

5. If an Eligible Participant is a FedEx or TNT Express business account holder whose business or company is registered in Australia, then an individual person may be nominated as its representative ("Nominated Representative") and participates on the Eligible Participant's behalf, but not in his/her own name or on his/her own behalf. Only one Nominated Representative is permitted per Eligible Participant.

6. Eligibility to participate excludes the directors, management and employees (and their immediate families) of FedEx, its related entities, suppliers, subcontractors, service providers and agencies associated with the Promotion stated herein as well as employees, agents, officers, and representatives of any government department, government-owned entity, juristic person funded by any government department, political party or public international organisation, or any candidates for political office.

An Eligible Entry

7. An Eligible Participant who makes Eligible Shipments as outlined in clauses 9 and 14 during the Promotion Period, will receive an automatic entry into the Promotion for the chance to win one (1) Super Rugby signed Jersey or one (1) of four (4) AU$250 online gift cards issued by Prezzee (see https://prezzee.com.au for further details).

8. One FedEx Express air waybill or one TNT Express consignment note is equivalent to one shipment.

9. To receive an entry, Eligible Participants must make the corresponding number of shipment(s) using the corresponding shipping service:-

a) One (1) entry for every one (1) TNT Priority Domestic Services.

b) One (1) entry for every three (3) FedEx International Services.

c) One (1) entry for every five (5) TNT Standard Domestic Services.

Examples:

• An Eligible Participant makes two (2) shipments using TNT Priority Domestic Services and five (5) shipments using TNT Standard Domestic Services during the Promotion Period will receive three (3) entries into the Promotion.
• An Eligible Participant makes two (2) shipments using FedEx International Services during the Promotion Period will not receive an entry into the Promotion.

10. Pooling of shipments from multiple accounts is not permitted and such pooled shipments are not eligible to earn rewards in this Promotion.

11. FedEx accepts no responsibility for any late, lost or misdirected entries including delays in the pickup/delivery of a shipment to participate in this Promotion due to technical disruptions, network congestion or any other reason.

12. If an Eligible Participant does not want to receive further promotional or direct marketing activities, the Eligible Participant may click the unsubscribe link at the bottom of any FedEx or TNT Express email notifications (including those relating to this Promotion or other campaigns/promotions) or call the Customer Service Hotline at 13 26 10.

Entry to Promotion

13. An Eligible Participant’s entry in this Promotion is confirmed after the Eligible Participant makes an Eligible Shipment in accordance with these Terms and Conditions.

Eligible Shipments

14. Eligible Shipments must meet all the following requirements:

a) Eligible Shipments must be booked, tendered to, and collected by FedEx or TNT Express and delivered to a FedEx or TNT Express serviced address during the Promotion Period, using any of the following FedEx or TNT Express shipping services:

i. TNT Priority Domestic Services: 9:00 Express, 10:00 Express, 12:00 Express, Overnight Express, Domestic Time Critical Local Courier Services (Standard Courier, Premium Courier, or Direct Courier), or Domestic Time Critical Next Flight.

ii. FedEx International Services: FedEx International Priority, FedEx International Priority Freight, FedEx International DirectDistrubution, FedEx International Economy, or FedEx International Economy Freight, or FedEx International Economy Service.

iii. TNT Standard Domestic Shipment: Domestic Road Express Service.

b) Total minimum consignment weight per shipment is one (1) kilogram.

c) Eligible Shipments must meet the requirements of FedEx and TNT Express’ applicable terms and conditions, including but not limited to the TNT Express Standard Terms and Conditions of Carriage and Other Services (for domestic services) or the FedEx Standard Conditions of Carriage (for international services).

d) Eligible Participants must use their FedEx or TNT Express Account Number to book an Eligible Shipment. If the Eligible Participant is a FedEx account holder shipping TNT Express services, the Eligible Participant must use the newly opened TNT Express Account Number linked to the existing FedEx account.

e) All invoices relating to Eligible Shipments must be paid for by the Eligible Participant in accordance with the terms of the invoice or the Eligible Participant’s agreement with FedEx or TNT Express.

f) Eligible Shipments do not include:

• The following TNT Express Domestic Time Critical Services: Dedicated fleet, Taxi trucks, Failsafe and Mission Critical;
• All TNT Express International Services;
• TNT International Air Freight;
• TNT International Sea Freight; and
• TNT International Special Express.

Prizes

15. The draw will take place at 4 pm (AEDT) on Thursday 21 November 2024 (“Draw Date”) at 201 Coward Street, Mascot, NSW 2020, and will be conducted by FedEx.

16. The first five (5) unique Eligible Entries randomly drawn, which have been submitted by unique Eligible Participants in accordance with these Terms and Conditions (“Winner” or “Winners” as the context requires), will win one of the following Prizes, awarded in the following order:

a) first, one (1) winner of a 2024 Super Rugby signed jersey; and

b) then, four (4) winners of four (4) AU$250 Prezzee online gift cards.

(referred to as “Prize” or “Prizes” as the context requires).

17. The Winner of the 2024 Super Rugby jersey will be required to choose from one (1) jersey from the following five (5) Super Rugby teams, signed by all 2024 players of that team: ACT Brumbies, Melbourne Rebels, NSW Waratahs, Queensland Reds or Western Force. To the extent permitted by applicable law, the Winner’s choice is final, irrevocable and cannot be changed.

18. A list of Winners will be made available on FedEx’s and / or TNT Express’ website. Further, Winners will be notified in writing by email and or by phone.

19. Any taxes which may be payable as a consequence of a winner receiving a Prize are the sole responsibility of the Winners.

20. Each Winner is solely responsible for complying with any terms and conditions that may be imposed on the use of the Prize by a third party responsible for providing any Prize. Winners are deemed to have reviewed, understood, and accepted any such terms and conditions upon entry into this Promotion.

21. The Prizes will be sent from FedEx’s Head Office – 201 Coward Street, Mascot, NSW 2020 within 21 days of the Draw Date. If any of the Winners cannot be contacted and/or are unable to accept the prize within four (4) weeks after the Draw Date, the Prize will be deemed forfeited. In such case, a new draw will take place.

22. To the extent permitted by applicable law, FedEx’s decision is final, and no correspondence will be entered into regarding results. The Prizes are not exchangeable, transferable or redeemable for cash or other products or services. FedEx will only award the Prizes following Winners’ validation and verification.

23. FedEx reserves the right to redraw in the event of an Eligible Participant being unable to satisfy these Promotion Terms and Conditions, forfeiting or not claiming a Prize. If any of the Prizes remain unclaimed or forfeited through ineligibility or otherwise, FedEx will conduct a further draw on Thursday 16 January 2025 (“Redraw Date”) and the winner/s will be notified in writing and/or by a phone call. No further draws will be undertaken after the Redraw Date.

24. To the extent permitted by applicable law, FedEx reserves the right to replace the Prizes stated herein with other items of equivalent value without notice.

General Terms and Conditions

25. Except for any liability which cannot be excluded by applicable law, FedEx shall not be liable for any loss or damage (including but not limited to indirect or consequential loss or, without limitation, loss of profits, loss of revenue, loss or denial of an opportunity, loss of goodwill) which is suffered by an Eligible Participant or other parties in connection with this Promotion, including but not limited to (a) personal injury; (b) tax obligations that may arise from accepting and using any Prize; (c) any technical difficulties or equipment malfunction (whether or not under FedEx’s control); (d) any theft, unauthorised access or third party interference; (c) incorrect details lodged by Eligible Participants; (e) any shipment that is late, lost, altered, damaged or misdirected (whether or not after their receipt by FedEx) due to any reason beyond the reasonable control of FedEx; (f) possession or use of a Prize; or (g) any failure by a Winner to adhere to any terms and conditions imposed by a third party responsible for providing the Prize. In addition, participation in this Promotion and/or use of any Prize is entirely at the own risk of the Eligible Participant and for their own account.

26. FedEx reserves the right to require an Eligible Participant to execute a certificate of eligibility prior to awarding him/her with the gift card, confirming that the Eligible Participant is not excluded from participating in this Promotion pursuant to these Terms and Conditions and that the Eligible Participant has complied fully with these Terms and Conditions. Truthful completion of this certificate is a precondition to the award of the Promotion Prizes.

27. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to this Promotion, these Terms and Conditions will prevail.

28. By entering this Promotion, each Participant who enters the Promotion consents FedEx Express Australia Pty Ltd to use his or her personal information in connection with this Promotion for the purposes of facilitating the conduct of the Promotion, complying with all laws applicable to conducting this Promotion and providing the Prizes, including but not limited to, publishing the names of winners in emails and on FedEx’s and / or TNT Express’ website. Without limiting the foregoing, each Participant’s personal information provided in connection with this Promotion will be handled in accordance with FedEx’s / TNT Express’ Privacy Policy, a copy of which is available by contacting FedEx or TNT Express or online (https://www.tnt.com/dam/tnt_express_media/en_au/download_documents/Support/terms-policy/TNT-Privacy-Policy-Apr2021.pdf)

29. If this Promotion is not capable of running as planned for any reason, including tampering, unauthorised intervention, fraud, technical failures and any other causes beyond the control of FedEx, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Promotion, FedEx, to the extent permitted by applicable law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion.

30. The terms and conditions of carriage in the applicable domestic consignment note, in effect on the day of any shipment, shall apply to the shipment. If there is a conflict between the terms of the domestic consignment note and / or international air waybill and these Terms and Conditions, the domestic consignment note and / or international air waybill will prevail.

31. FedEx will not be obliged to award the prizes if it is contrary to any applicable laws or regulations.

32. To the extent permitted by applicable law, FedEx reserves the right to amend these Terms and Conditions at any time without notice.
